Mr.M.Rajarajan, learned Government Advocate takes notice on behalf of the respondents.
2.This writ petition has been filed for issuance of a direction, directing the 3rd respondent to release the petitioner's Ashok Leyland Lorry bearing registration Number TN 88 Y 4423, seized on 21.06.2019 and keeping under the custody of the 3rd respondent by considering her representation dated 24.06.2019. 3.The petitioner's vehicle was seized for illegal transportation of sand on 21.06.2019. In this regard, she made a representation on 24.06.2019. Yet without filing F.I.R, the vehicle is kept under the custody of the third respondent. W.P.(MD) No.24522 of 2019 approached the Special Court, it was returned on the ground that no F.I.R number is given.
4.Considering the facts and circumstances, a direction is given to the first respondent/Revenue Divisional Officer, Karur, to immediately lodge an F.I.R and forward the same to the concerned Special Court. A further direction is given to the Special Court to entertain the petition filed by the petitioner before it and consider the return of vehicle in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
