This writ petitioner filed this Writ of Mandamus, directing the 2nd respondent to not to interfere in the civil dispute existed between the petitioner and the 3rd respondent based on the petitioners representation dated 22.09.2023.

2. Mr.R.M.Anbunithi, learned Additional Public Prosecutor takes notice for the respondents.

3.Heard both sides.

4. Learned counsel for the petitioner submitted that on the basis of the complaint given by the third respondent, the petitioner was summoned to appear before the second respondent for enquiry. According to the learned counsel for the petitioner, it is purely a civil dispute over which a suit is pending in O.S.No.64 of 2010. There was also decreed in favour of this petitioner against which appeal has also 2/4

preferred and a petition under Section 47 of C.P.C., has been filed by the third respondent, which is stated to have pending before the District Munsif Court, Theni. Pending the proceedings, now the petitioner has been summoned to appear.

5. Learned Additional Public Prosecutor would submit that the parties have been advised to work out their remedy in the civil suit stated to be pending and the complaint was closed.
