Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Certiorarified Mandamus, calling for the records relating to the impugned order made by the 2nd Respondent in R.C.No.22490/E3/2023 dated 14.08.2023 and quash the same and consequently direct the respondents to grant the monthly pension received by the petitioner without any hindrance.

The instant writ petition has been filed by a Superintending Engineer working in the Public Works Department, challenging the communication issued by the 2nd respondent dated 14.08.2023, directing the 3rd respondent to stop all the pension payment of the petitioner under Rule 39 of Tamil Nadu Pension Rules, 1978.

2. Since the final order has already been passed by the first respondent invoking Rule 39 of Tamil Nadu Pension Rules, nothing survives to be adjudicated in the present writ petition.
