To call for the records pertaining to the order dated 11.10.2022 passed by the Judicial Magistrate No.I, Padmanabhapuram in Crl M.P No. 5231 of 2022 and set aside the same.

Order : This Criminal Miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.MAYILVAHANA RAJENDRAN.C, Advocate for the petitioner and of MR.S.MANIKANDAN, Government Advocate on behalf of the Respondent the Court made the following order:- 1/4

This petition has been filed to condone the delay of 260 days in filing the Criminal Revision Case against the order dated 11.10.2022 in Crl.M.PNo.5231 of 2022 on the file of the learned Judicial Magistrate No.1, Padmanabhapuram.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.side) for the respondent.

3. I have perused the affidavit filed in support of this application and being satisfied with the reasons stated in the affidavit and considering the duration of delay, this Court is inclined to allow this petition on payment of cost. Accordingly, this petition is allowed on condition that the petitioner shall pay a sum of Rs.1,000/- (Rupees One Thousand Only) to the credit of the District Siddha Medical Officer CCRI PKM, A/C.No.10767823177, IFSC CODE : SBIN0000898, MICR CODE : 625002601, State Bank of Indida, Periyakulam for the welfare of the Siddha Clinic attached to this Court within a period of two weeks from the date of receipt of a copy of this order, failing which, the petition shall stand automatically dismissed without further reference to this Court.
