PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents 1 to 4 herein to take action against the respondents 6 to 11 herein with regard to the manipulation of master's attendance register incidents took place on 26.10.2021, 24.11.2017, 21.10.2021, 17.12.2018, 05.02.2019, 21.09.2021, 06.10.2018 and 13.10.2021 and allegation with regard to the instigating student illegally and take departmental proceedings under Rule 17 (b) of the Tamil Nadu Civil Service Discipline and Appeal Rules and direct the respondents 1 to 4 herein to alter the charge memo dated 12.05.2022 issued against the respondents 6 to 8 herein with regard to the manipulation of master attendance register incidents dated 18.09.2018 and 25.10.2018 under Rule 17(b) of the Tamil Nadu Civil Service Discipline and Appeal Rules.

The petitioner, an ex-serviceman and a Secondary Grade Teacher has approached this Court with certain allegations on the administration of Panchayat Union Primary School, Maruthamputhur that certain teachers working in that School have indulged in malpractice.

2.Today(04.12.2024), when this writ petition is taken up for hearing, the learned Special Government Pleader appearing for the respondents submits that the allegations of this petitioner have been attended and action has been taken by issuing summons to the concerned teachers, including the petitioner, calling for their explanation to conduct an enquiry.

3.The learned Counsel appearing for the petitioner submits that the allegations are of serious in nature. However, a lenient view has been taken by the higher officials by issuing a charge memo under Rule 17(a) of Tamil Nadu Civil Service (Discipline &Appeal) Rules,1955 to the erring teachers. 4.Recording the submission made by the learned Special Government Pleader that the officials have already initiated proceedings as against the erring teachers, with a hope that they would conduct a proper enquiry in accordance with law, this writ 4/6

petition is closed. No costs. Consequently, connected Miscellaneous Petition is closed.
