Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the 1st respondent to consider and pass an order on the representation dated on 02.10.2019 implementing order made in Ref.No.MaPo4/006900/18 dated 29.12.2018 and Ref.No.MaVa4/27955/18 dated 21.5.2019 in letter and spirit by allotting shops under the Madurai Smart City Scheme to the members of the petitioner's Association in and around the Arulmigu Meenakshi Sundareswarar Temple, Madurai.

Mr.Prabhu Ramachandran, learned Standing Counsel takes notice on behalf of the first respondent. Mr.V.R.Shanmuganathan, learned Special Government Pleader takes notice on behalf of the second respondent.

2.This writ petition has been filed for issuance of a direction, directing the 1st respondent to consider the representation of the petitioner, dated 02.10.2019, by implementing the order made in Ref.No.MaPo4/006900/18 dated 29.12.2018 and https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD) No.24476 of 2019 Ref.No.MaVa4/27955/18 dated 21.5.2019 in letter and spirit by allotting shops under the Madurai Smart City Scheme to the members of the petitioner's Association in and around the Arulmigu Meenakshi Sundareswarar Temple, Madurai.

3.The petitioners were the shop owners of the shops situated in Veeravasantharayer Mandapam at Meenakshi Amman Temple. During the fire accident, the entire mandapam was damaged and all the shop owners were evicted from the fire affected area. At that time, it appears that some assurance was given to them to give preference, while allotting the shops, to be built under the Smart City Scheme in and around the Arulmigu Meenakshi Sundareswarar Temple, Madurai. With regard to that, they made a representation on 02.10.2019 and the same is pending till date. Since the Smart City construction work is nearing completion, the petitioners have approached this Court for considering their representation.

4.Considering the limited prayer, a direction is given to the respondents to consider the petitioners' representation dated 02.10.2019, and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
