ORDER
The present writ petition has been filed seeking a Mandamus as against the Sub-Registrar for registering the marriage between an Indian christian and Bangladesh muslim women under the Special Marriage Act.
2. According to the learned counsel for the petitioner, the respondents are hesitating to register the marriage without assigning any proper reasons.
3. The learned Additional Government Pleader appearing for the respondents points out that as per the statute, 30 days notice period is available and before that, they cannot register the marriage. Apart from that, the requisite fee has also not been paid. On completion of all the statutory formalities, the second respondent is directed to register the marriage, if the application is otherwise in order. 2/4
4. With the above said observations, this Writ Petition stands allowed. No costs.
