Heard the learned counsel on either side.

2.The relief sought for cannot be granted straightaway by this Court. The petitioner has to necessarily obtain relief only in the appeal that has been filed before the first respondent. The first respondent is directed to dispose of the petition mentioned appeal on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. I make it clear that I have not gone into the merits of the matter. It is open to the first respondent to pass order one way or the other. 3.The writ petition is disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed.
