Criminal Original Petition filed under section 482 of Criminal Procedure Code, to issue direction to the 1st and 2nd respondents to provide adequate police protection, while the 3rd respondent and other Revenue Officials are measuring and lay the boundary stones in the petitioner's land in S.F.No.264/11 measuring about 3930 sq.ft. situate in Sandhaiyur Group, S.Melapatti Village, Peraiyur Taluk, Madurai District.

O R D E R
This Criminal Original petition has been filed to direct 1st and 2nd respondents to provide adequate police protection, while the 3rd respondent and other Revenue Officials are measuring and trying to lay boundary stones in the petitioner's land in S.F.No.264/11 measuring about 3930 sq.ft. situated at Sandhaiyur Group, S.Melapatti Village, Peraiyur Taluk, Madurai District.

The learned counsel for the petitioner would submit that the petitioner is the absolute owner of the property in S.F.No.264/11 measuring about 3930 sq.ft. situated at Sandhaiyur Group, S.Melapatti Village, Peraiyur Taluk, Madurai District. Therefore, he wants to survey the said property and that he https://hcservices.ecourts.gov.in/hcservices/ 1/2
Crl.O.P(MD).No.17172 of 2019 approached the concerned revenue officials by way of filing proper application and also paid requisite fee to survey his land before the Tahsildhar, Peraiyur Taluk, Madurai District. He further submitted that when the surveyor was trying to measure the land, one Karuppaiah and his group have prevented the Surveyor from measuring the land.
3.Considering the above facts and circumstances of the case, if the Surveyor is directed to survey the land as requested by the petitioner, and if the Surveyor feels any hindrance while surveying the land belonging to the petitioner, he can very well seek police protection before the second respondent. If any such complaint is lodged by the Surveyor while surveying the land seeking police protection, the second respondent is directed to consider the same and pass orders on merits and in accordance with law.
4. With the above observation and direction, this Criminal Original Petition stands disposed of.
