Respondent/Respondent/Complainant Prayer :- Civil Revision Petition filed under Section 115 of the Civil Procedure Code, to set aside the order dated 27.07.2017 in E.A.No.87 of 2017 in E.P.No.55 of 2014 in O.S.No.896 of 1971 on the file of the Principal District Munsif, Kuzhithurai. ORDER:- This Civil Revision Petition coming on for orders on this day and upon perusing the earlier order of this Court dt.10.01.2022 and the requisition letter submitted by the Principal District Munsif, Kuzhithurai, in D.No.176/2022 dated 03.03.2022 and upon hearing the arguments of Mr.G.Prabhu Rajadurai, Advocate for the Petitioner and of Mr.V.M.
Bala Mohan Thampi, Advocate for the 9th, 11th, 12th, 20th and 22nd to 24th Respondents, and this Court made the following order:- This Court by order, dated 10.01.2022 directed the Executing Court to dispose the EP.No.55 of 2014 within a period of one month from the date of receipt of a copy of that order. Now, the Principal District Munsif, Kuzhithurai has filed a report and seeks further more time for disposal of E.P.
2. According to the report given by the District Munsif, the petitioner in E.A did not cooperate to the Court to proceed with the matter further and hence, E.P is pending. Since the E.A was dismissed for default on 14.02.2022, now, the E.P Petition is posted on day to day basis. Since the EAs are disposed of, this Court is inclined to extend the time for a further period of one month.
3. Accordingly, the time is extended for a further period of one month from the date of receipt of a copy of this order to dispose the E.P.
