O R D E R

This Criminal Original Petition has been filed to call for the entire records pertaining to the case in C.C.No.2413 of 2022 pending on the file of the learned Judicial Magistrate No.II, Madurai and quash the same as against the petitioner.

2. According to the prosecution, the petitioner and the 2nd respondent became friends in the year 2012 while studying law at Madurai Law College. The 2nd respondent got married in the year 2014. Even after knowing this, the petitioner allegedly continued to follow her and insisted on marrying her. He is also alleged to have threatened to commit suicide if she refused. It is further alleged that the petitioner behaved abnormally and created morphed photographs of the 2nd respondent using pictures in his possession. He also made frequent phone calls to her. Because of this, the 2/8

2nd respondent filed a complaint at Thirumangalam Police Station in 2020. During the enquiry, the petitioner deleted the photographs and gave an undertaking not to repeat such acts. Despite this, the petitioner allegedly again started following the 2nd respondent and visited the office where she was working as a junior advocate. For the past four months, he is said to have followed her and threatened her by showing the morphed photographs and forcing her to agree to his demands. It is also alleged that on 02.02.2022, the petitioner threatened the senior of the 2nd respondent over the phone. On 13.12.2021, at this Hon'ble High Court, he allegedly stopped her two-wheeler and picked up a quarrel, from which she was rescued by her colleagues. He is said to have continued to follow her without any reason.

It is further alleged that the petitioner sent daily messages and made repeated phone calls from his mobile number, thereby disturbing and invading the privacy of the 2nd respondent. Due to continuous harassment, she was forced to lodge a complaint before the 1st respondent. Based on the complaint lodged by the 2nd respondent, the 1st respondent registered the First Information Report in Crime No.

the petitioner and thereafter, the case has been charge sheeted in C.C.No. 2413 of 2022 on the file of the learned Judicial Magistrate No.II, Madurai.

It appears that pending quash petition, the parties viz., petitioner and the 2nd respondent / de facto complainant have settled their dispute amicably out of Court, at the instigation of the elders and well wishers and they have also entered into a compromise. A joint compromise memo signed by the parties concerned is produced before this Court, which reads as follows:

"1. It is submitted that the Petitioner and the 2nd respondent would jointly submit that in view of the arrival of compromise that has been occurred at the intervention of friends and well wishers, in order to give a quietus to the entire episode between the petitioner and the 2nd Respondent, the present memo is being pressed into service.

2. It is further that the 2nd Respondent has given a complaint before the 1st Respondent Police against the petitioner which was registered FIR in Crime No.4/2022 on 06.02.2022. It is further submitted that after filing the above FIR the Charge Sheet also laid in C.C.No.2413/2022 offence under sections 294(b). 354(D), 506(ii) of IPC and section 4 of Tamil Nadu Prohibition of Harassment of Women Act add the same is pending before the learned Judicial Magistrate Additional Mahila Court, Madurai. However, after challenging he said proceedings before this Hon'ble Court through main quash petition, both the parties have realized the fact that they would not have gone for 4/8

litigating the litigations against each other, as a result of which, they have chosen to have the peace talks with the participation of their friends and well-wishers and such effort has ultimately brought a fruitful result.

3. It is further submitted that the Petitioner and the 2nd Respondent would jointly submit that for the arrival of Compromise, none of them has either tutored or coerced from any outer force. Both of them make it very clear that the present amicable status has come into existence purely on their own volition.

4. It is further submitted that the Petitioner and the 2nd Respondent also jointly give an undertaking that henceforth, against each other, they would not give complaint in any form and before any authority for any allegation in respect of their respective personal life and further they also give an further undertaking that hereafter they would not interfere or disturb each other's Life and their Court Practice in any manner.

It is therefore to record the above compromise prayed that this Hon'ble Court may be pleased arrived between the petitioner and the de facto complainant and prays this Hon'ble Court to quash the Charge Sheet in C.C.No 2413 of 2022 on the file of the learned Judicial Magistrate, Additional Mahila Court, Madurai in Crl.0.P(MD)No. 17581 of 2023 and pass such other orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and thus render justice."

4. In the Compromise Memo, the de facto complainant has agreed to withdraw the criminal case and the petitioner and the second respondent 5/8

have requested this Court to quash the proceedings in C.C.No.2413 of 2022 on the file of the Judicial Magistrate No.II, Madurai.

5. In the said circumstances, this Court is of the view that no useful purpose will be served by keeping this matter pending. Hence, on the basis of the compromise memo signed by the parties, this Criminal Original petition is allowed and the proceedings pending in C.C.No.2413 of 2022 on the file of the Judicial Magistrate No.II, Madurai is quashed in toto. The Joint Compromise Memo signed by the parties shall form part of this order. Consequently, the connected Miscellaneous Petitions are closed. 25.11.2025 Index:Yes/No Internet:Yes/No trp 6/8
