Prayer Crl O.P(MD)No.17366 of 2022 :- Criminal Original Petition filed under Section 482 of Cr.P.C, praying to direct the District and Sessions Court (PCR) Ramanathapuram to consider the bail application of the Petitioner on the same day of surrender on merits in Crime No.143 of 2022 on the file of the second Respondent Police.

ORDER:- This Criminal Miscellaneous Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.T.Veerakumar, Advocate for the Petitioner and of Mr. R. Suresh Kumar, Government Advocate for the respondents 1 & 2, this Court made the following order:

Crl.O.P.(MD) No.17366 of 2022 had been filed to direct the learned Judge, District and Sessions Court, (PCR), Ramanathapuram, to consider the bail application of the Petitioner on the same day of surrender on merits in Crime No.143 of 2022 on the file of the second Respondent.

2.Crl.O.P.(MD) No.17366 of 2022 was disposed of by this Court, vide order dated 14.10.2022, granting two weeks time to the Petitioner to surrender before the District and Sessions Court (PCR), Ramanathapuram, from the date of receipt of a copy of the order. After grant of the order, the Petitioner suffered from chicken box. Therefore, he was unable to surrender before the District and Sessions Court, (PCR), Ramanathapuram, within the time specified in the order dated 14.10.2022 in Crl.O.P.(MD) No.17366 of 2022. Therefore, Crl.M.P.(MD)No.14037 of 2022 is filed to extend the time limit of the Petitioner to surrender before the District and Sessions Court, (PCR), Ramanathapuram.

3.Considering the explanation offered by the learned Counsel for the Petitioner, this Petition is allowed, granting two weeks further time to the Petitioner from the date of receipt of a copy of this order to comply with the conditions imposed upon the Petitioner in Crl.O.P(MD) No.17366 of 2022 dated 14.10.2022.
