PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the respondents to disburse the petitioners retirement benefits namely provident Fund, Gratuity Leave Salary and commutation within the stipulated time frame fixed by this Court. ORDER

The instant writ petition has been filed by a retired employee of the respondent transport corporation, seeking a mandamus for disbursement of the terminal benefits immediately.

2.The learned Standing Counsel appearing for the respondent transport corporation submitted that due to paucity of funds, the terminal benefits of the employees are being released based on their date of retirement. As on today, the retirement benefits have been released only to those employees who retired in November 2022.

3.The learned Counsel appearing for the petitioner submitted that he has fixed the marriage of his daughter and due to emergent situation, the terminal benefits may be released forthwith as a special case. 4.In view of the above said facts, this Court is inclined to pass the following order:- a)the respondents transport corporation herein are directed to release 50% of the EPF amount on or before 30.11.2024;

b)the balance EPF amount shall be released on or before 31.01.2025; and c)the entire terminal benefits shall be released on or before 30.06.2025. 5.With the above said observations, this writ petition stands disposed of. No costs.
