PRAYER : Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondent to dispose the original application in O.A.No.19 of 2023 within the time stipulated by this Court.

O R D E R

The petitioner, with a grievance that the original application filed by him in O.A.No.19 of 2023 under Section 63(b) of the Hindu Religious and Charitable Endowments Act, for declaring him as Hereditary Trustee is pending for more than five months, has filed the present writ petition seeking for early disposal of the said application.

2. The learned Special Government Pleader appearing for the respondent submits that the application was filed by the petitioner under Section 63(b) of the said Act only on 23.05.2023 and the respondent has already issued notice to the parties and has fixed the date of hearing on 19.10.2023. He further submits that the respondent requires minimum nine months for concluding the proceedings.

3. Since the respondent has already issued notice for conducting enquiry on the application filed by the petitioner, the respondent is directed to dispose of the original application filed by the petitioner in O.A.No.19 of 2023, within a period of six months from the date of receipt of a copy of this order.

4. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
