ORDER

The Writ Petition has been filed, invoking Article 226 of the Constitution of India, seeking orders, to direct the respondents 1 to 3 to take necessary action as against the fourth respondent, strictly in accordance with the direction of the Apex Court in Lalitha Kumari Vs. Government of Utta Pradesh and others, on the basis of the petitioner's representation, dated 19.09.2024.

2.The learned counsel for the petitioner would submit that the petitioner is the Panchayat President; that the fourth respondent has abused the petitioner in filthy language in Whatsapp group and that the petitioner is having pendrive to prove the same.

3.When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for the State would submit that on the basis of the complaint given by the petitioner, CSR.No.97 of 2024 came to be registered and enquiry is pending. 2/4

4. Recording the submission made by the learned Additional Public Prosecutor, the petitioner is directed to produce the evidence available with him to the third respondent and on such receipt, the third respondent is directed to issue notice to the petitioner as well as the private respondent and conduct enquiry and take a decision within a period of two weeks from the date of receipt of copy of this order.

5. With the above direction, this Writ Petition is disposed of. No costs.
