PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents 1 to 3 to remove the encroachment made by the respondents 4 to 8 in water channel in respect of Survey No.174/4 to an extent of 0.33.00 acres situated at Chinnapoolampatti Village, P.Ponnaiahpuram, Peraiyur Taluk, Madurai District in the light of proceedings of the second respondent in Na.Ka.No.2045/2018/A4 dated 29.06.2018 and pursuant to the representations dated 25.02.2019 and 01.07.2019.

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM, J.) The Writ Petition has been instituted to remove the encroachments. 2.The learned Government Pleader appearing on behalf of the respondents 1 to 4 submitted that fencing has been constructed by encroaching upon the water channel (Oorani).

3.In view of the said allegations, the respondents 1 to 4 are directed to conduct a field inspection and survey, identify encroachments if any and thereafter initiate appropriate action for removal of encroachments by following the procedures as contemplated under the relevant statutes and rules in force, after affording due opportunity to the parties. The said exercise is directed to be completed within a period of twelve weeks from the date of receipt of a copy of this order.

4.Accordingly, this Writ Petition stands disposed of. There shall be no order as to costs.
