2 W.P.(MD)NO.25466 OF 2024 Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 to 5 herein suitably directed to take appropriate steps as to remove the encroachment / obstruction/compound wall put up by the sixth respondent in survey No.374/1 which is classified as Government poramboke land (public pathway) situated at Kangaraseval Village, Vembakkottai Taluk, Virudhunagar District and in survey No.384 classified as Government poramboke land-Neerpidipu(water body) situated at Kangaraseval Village, Vembakkottai Taluk, Virudhunagar District by considering the representation dated 06.09.2024 given by the writ petitioner within the time limit fixed by this Court.

2. The scope of this writ petition is confined only to survey No.384. Liberty is given to the petitioner to take independent steps in respect of survey No.374 which is not a water body. The allegation of 2/5
3 W.P.(MD)NO.25466 OF 2024 the petitioner is that the sixth respondent had committed encroachment in respect of survey No.384.
3. The fourth respondent is directed to issue notice to the private respondents and other encroachers if any, conduct survey and if the encroachments are noticed, then by adhering to due process of law, the encroachments shall be removed. The entire exercise will be completed within a period of four months from the date of receipt of a copy of this order. This writ petition stands disposed of accordingly. No costs.
