: Respondent PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondent to transfer the ownership of the house situated in door No.5/23, Manchal Mettu Theru, Madurai South, Arasaradi, Madurai District, to the petitioner's name, by considering his representation dated 29.08.2019.

ORDER

The petitioner seeks a direction to transfer the ownership of the tenement situated in Door No.5/23, Manchal Mettu Theru, Madurai South, Arasaradi, Madurai District.

2. Mr.P.Mahendran, learned Standing Counsel, takes notice on behalf of the respondent.

3. By consent, the Writ Petition is taken up for final disposal at the stage of admission itself.

4. Originally, the tenement was allotted in favour of one Karuppi. She said to have executed a Will in favour of the petitioner, who is none other than her nephew. She died on 16.04.2007. Thereafter, the petitioner is continuing in possession of the tenement and sought for transfer of ownership. In this regard, he made a representation to the respondent on 29.08.2019. Since it is not considered, he prefers this Writ Petition.

5. Considering the facts and circumstances of the case, without going into the merits of the case, a direction is given to the respondent to consider the representation of the petitioner dated 29.08.2019 on merits and in accordance with law and pass https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.24646 of 2019 appropriate orders, within a period of four weeks from the date of receipt of a copy of this order.

6. The Writ Petition is disposed of with the above direction. No costs.
