The petitioner with a grievance that the respondents have issued patta to a larger extent of land to the fourth respondent has filed an application before the Revenue Divisional Officer on 24.09.2023, to cancel the patta issued to the fourth respondent and filed this writ petition, seeking a direction to the Revenue Divisional Officer to conclude the process as expeditiously as possible. 2.The learned counsel appearing for the petitioner submits that a punja land in Survey No.57/2, to an extent of 1 acre 96 cents, Perumbacheri Revenue Village, Ilayangudi Taluk, Sivagangai District is originally belonged to one Udaiyakkal. The petitioner has purchased 96 cents of land from the said Udaikkal on 24.08.1992. In a similar manner, the petitioner's brother/the fourth respondent herein has purchased another half portion of the land 2/5
from the said Udaiyakkal on 15.06.1992. However, patta for a larger extent of land has been issued to the fourth respondent vide T.R.No. 2022/103/23/1525/2TR, dated 17.08.2022. Therefore, the petitioner has filed an application on 04.09.2023 before the District Collector, Sivagangai to cancel the patta granted to the fourth respondent and the same was forwarded to the Revenue Divisional Officer, Sivagangai/the second respondent herein on 24.09.2023 and the same is pending in Petition No.267 of 2023. Since no action has been taken by the second respondent, the petitioner is before this Court with this writ petition.
3.Mr.B.Saravanan, learned Additional Government Pleader takes notice for the respondents 1 to 3 and submits that an enquiry on the petitioner's application has already been conducted, however, an order is yet to be passed.
4.Considering the submission made by the learned Additional Government Pleader and the fact that the application 3/5
filed by the petitioner is pending from the month of September 2023, this writ petition is disposed of with a direction to the Revenue Divisional Officer, Sivagangai to conclude the enquiry and pass suitable orders as expeditiously as possible, preferably within a period of eight weeks from the date of receipt of a copy of this order. No costs.
