ORDER
The grounds raised by the petitioner herein challenging the transfer order may not be sufficient grounds for the purpose of invoking the powers of this Court under Article 226 of the Constitution of India. It is the settled proposition that insofar as transfer orders are concerned, unless and until the mala fides are established or the authority is questioned, it would not be appropriate for this Court to interfere with the transfer order. 1/3
2.The learned counsel for the petitioner would suggest that if the petitioner is transferred to any other place other than Suruliyar Power House, she would be satisfied, since the petitioner being a lady, would find inconvenience serving in Suruliyar power house, which is a forest area. 3.The learned Standing Counsel for the respondents suggested that there is a vacancy in K.G.Patti power house. 4.This Court is of the view that if the petitioner is transferred to K.G.Patti instead of Suruliyar, the same would take care of the petitioner's interest. The learned counsel for the petitioner, on instructions from his client, would submit that it is agreeable for her to be posted at K.G.Patti instead of Suruliyar power house.
5.In view of the submission made by the learned counsel for the petitioner, the impugned transfer order dated 09.11.2019 stands modified to the effect that the petitioner herein, namely R.C.Meyalagi shall stand transferred and posted to K.G.Patti power house. The second respondent shall pass appropriate orders in the light of the modification made by this Court in the present order. 6.With the above observations, the Writ Petition stands ordered accordingly.
No costs.
