ORDER

This Criminal Original Petition had been filed to quash the impugned chargesheet in C.C.No.277 of 2022 on the file of the Learned District Munsif cum Judicial Magistrate Court, Tiruppuvanam, Sivaganga District.

Mr.R.Jagadeeswaran, learned Counsel for the petitioners, M.Veeranthiran, learned Government Advocate (Clr. side), Mr.M.Anbarasan, learned Counsel for the second respondent and the Sub Inspector of Police, Thiruppuvanam Police Station are present. As per the printed cause list, mediation is effected and the mediation report is also filed by the Mediator.

On perusal of the mediation report, it was found that the Mediator M.M.Iqbal had conducted mediation, whereby the first Petitioner herein who is the son of the second Respondent in Crl.O.P.(MD)No.18234 of 2023 had agreed to handover the possession of three tiled houses bearing Door No.1/17 on the southern side of Nelmudikarai, Thirukonam Taluk, Sivagangai District to the second respondent. The first Petitioner who is the son of the second Respondent had retailed two other houses on the northern side. Based on the settlement, both parties have no further claim and 2/4

demand, against each other and all the disputes had been amicably settled.

Considering the fact that the first Petitioner is the son of the DeFacto complainant/the second Respondent, the subject matter was referred to the mediation by the learned Judge of this Court and the settlement arrived at in the mediation. After several sessions, they had amicably settled and given a quitest to the pending criminal case. Therefore, in the light of the mediation report, the subject matter had been amicably settled. and the C.C.No.277 of 2022, pending on the file of the learned District Munsif cum Judicial Magistrate is quashed.

5. Recording the said submission, this Criminal Original Petition is allowed. Consequently, connected miscellaneous petitions are closed. 04.01.2024 Index : Yes/No Internet:Yes/No jbr 3/4
