ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offence punishable under Section 4(1)(b) of Tamil Nadu Prohibition Act, in crime No.213 of 2024 on the file of the respondent police, seeks anticipatory
bail.
2.The case of the prosecution is that on 02.09.2024 a car bearing Registration No.TN 45 S 5959 driven by the first accused had several liquor bottles without having valid documents. The respondent police arrested the first accused and based on his confession statement, the petitioner was arrayed as an accused.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed the offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner. 4.The learned Government Advocate(Crl.sdie) appearing for the State would submit that the petitioner is having two previous cases on similar in nature. 5.Considering the huge quantity of liquor which is found to be in illegal possession of the petitioner and considering the fact that the petitioner has got 2 two previous cases of similar in nature and considering the fact that the earlier anticipatory bail petition was also dismissed, this is not a fit case for grand of anticipatory bail.
