Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Mandamus, directing the 1st and 4th respondents herein to include my name as well as my children names as nominee and legal heir of the petitioner's husband Sethuraman in the Service Book maintained by the 4th respondent office by considering the representation of the petitioner dated 09.08.2024 with the time stipulated by this Court. 1/4

ORDER

The instant writ petition has been filed by the wife of one Sethuraman who is working as Sub Inspector of Police, seeking a mandamus to include her name as well as her children names as nominee and legal heir in the service book maintained by the fourth respondent office. 2.It could be seen from the affidavit that the petitioner claims that she is the first wife of the said Sethuraman and the said Sethuraman has deserted her and married his relative one Indirani. The said Sethuraman is about to retire in few years. Hence, the present writ petition has been filed. 3.On instructions, the learned Additional Government Pleader appearing for the respondents submits that based upon the said complaint lodged by the writ petitioner herein, detailed enquiry was conducted and orders were passed on 20.09.2024 directing the petitioner approach the competent civil Court to resolve the matrimonial dispute.

4.In view of the above said orders, this Court is not in a position to issue any mandamus to the official respondents. It is for the petitioner to work out her remedy before the competent civil Court.

5.With the above said observations, this writ petition stands disposed of. No costs.
