Prayer in CRL RC(MD). 446/ 2024 :

To set aside the judgment made in Crl Appeal no. 80/2021 dated 11.01.2024 on the file of Vth Additional District court, Madurai confirming the punishment of three months simple Imprisonment with fine of Rs.1,00,000/- in default of fine amount, the petitioner shall undergone one month simple imprisonment rendered by Trial Court in S.T.C.No.3702 of 2019 dated 30.04.2021 on the file of the Judicial Magistrate No.II, Madurai.

Order : This Criminal Miscellaneous Petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.V.P.RAJAN, Advocate for the petitioner and of Mr.E.ANTONY SAHAYA PRABAHAR, Additional Public Prosecutor on behalf of the Respondent, the court made the following order:- This petition has been filed to relax the condition imposed against the petitioner in Crl.M.P.(MD)No.4723 of 2024 in Crl.R.C.(MD) No.446 of 2024, dated 29.04.2024.

2. Heard the learned counsel for the petitioner and also perused the records. 3.It is seen from the records that this Court in Crl.MP(MD)No.4723/2024, while suspending the sentence, has directed the petitioner to appear before the trial Court once in a month ie., on the first working day of every English Calender month. 4.Since the Criminal Revision case is pending and also the fact that the petitioner has been complying with the conditions from May 2024, this Court is not inclined to relax the conditions.

5.The petition is dismissed accordingly.
