For Respondent : Mr.M. Muthumanikkam, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.23 of 2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 419, 420, 458, 471 r/w. 34 IPC and 66C, 66B, 84B of IT Act, in Crime No.23 of 2022 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that due to matrimonial dispute between the one Vijay and his wife viz., Juli, the said Vijay wanted to verify the moments of the said Juli has contacted the complainant and in turn the complainant approached one Sathishkumar, who is running a detective agency and gave a sum of Rs.21,000/-. But, he has not made any effort to repay the amount nor monitor the said Juli. Hence, the complaint.
3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and his name has been falsely implicated in this case. He would further submit that the name of https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.20222 of 2022 the petitioner is not found in FIR and he seeks anticipatory bail.
4. The learned Government Advocate (Crl. Side) appearing for the respondent would submit that totally four accused involved in this case and the petitioner herein is arrayed as A1. He would further submit that co-accused have already released on bail and the petitioner herein is the main accused. He further contended that investigation of the case is in preliminary stage and hence, the custodial interrogation of the petitioner is necessary and he strongly opposed to grant anticipatory bail to the petitioner.
5. Considering the submission made by the learned Government Advocate (Crl. Side) appearing for the respondent and also considering the serious nature of allegations made against the petitioner and that the investigation of the case is in preliminary stage, this Court is not inclined to grant anticipatory bail to the petitioner.
