Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to call for the records pertaining to the FIR in Crime No. 821 of 2021 on the file of the respondent police and quash the same insofar as petitioner concerned.

O R D E R

The petitioner/accused in Crime No.821 of 2021, on the file of the first respondent police has moved this petition to quash the above proceedings pending as against him.

2.Mr.P.Kottaichamy, learned Government Advocate (Crl.side), who takes notice for the first respondent submits that the investigation in Crime No. 821 of 2021 has already been completed and final report has also been filed before the Judicial Magistrate Court No.II, Madurai, through e-filing No.C202401069, on 16.12.2024. 3.Recording the aforesaid submission made by the learned Government Advocate (Crl.side) that the final report has been filed, this Court is not inclined to proceed with the first information report alone. It appears that for the case, which was registered in the year 2021, the final report came to be filed only in the year 2024 and it is also not taken on file so far. Mere filing of the final report is not sufficient and it is the responsibility of the respondent police to ensure that the final report is filed in order and it is taken on file by the concerned Court within a 2/4

period of two weeks. It is also the responsibility of the concerned Courts to take the final report on file, without delay. 4.In view of the above, this Criminal Original Petition is dismissed with liberty to the petitioner to challenge the final report in the manner known to law. The learned Magistrate No.II, Madurai shall take the final report on file, if it is in order and proceed with the trial.
