PRAYER :- for bail in Crime No.137 of 2019 on the file of the respondent police.

ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate(Crl. Side) appearing for the respondent.

2. The petitioner is in custody since 27.08.2019 for the offences punishable under sections 8(c) r/w 20(b)(ii)(c), 29(i) and 25 of NDPS Act, in Crime No.137 of 2019 on the file of the respondent police. He seeks bail.

3.The contraband involved in this case is 294 kg of ganja. It is a commercial quantity. Therefore, the tests laid down in Section 37 of NDPS Act will have to be satisfied.

4.The learned Government Advocate (Crl.side) pointed out that Ravi-A6 in this case had clearly and categorically spoken about the role played by the petitioner herein in his confession statement. https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.17575 of 2019 5.The learned Government Advocate (Crl.side) also states that the call data reveals that the petitioner herein was in regular touch with the main accused. The main accused is yet to be arrested.

6.Since the investigation is still pending, the question of granting bail to the petitioner herein does not arise at this stage.
