For Petitioner : Mr.P.Devarajan For R1 : Mr.E.Antony Sahaya Prabahar Additional Public Prosecutor
ORDER
The Criminal Original Petition is directed against the summons 1/4
dated 06.10.2024 issued by the first respondent.
2. The learned Additional Public Prosecutor appearing for the first respondent would submit that the petitioner is having 7 previous cases, out of which, four cases were under Section 420 IPC.
3. The learned counsel appearing for the petitioner would submit that the second respondent, after receiving the statutory notice under Section 138 of Negotiable Instruments Act, has lodged the present false complaint and that the second respondent, without receiving the notice, has seen the notice and after reading the contents of the notice, had managed to return the same.
4. As rightly pointed out by the learned Additional Public Prosecutor, the petitioner was summoned to appear for enquiry in the complaint given by the second respondent. Since the first respondent has issued summons directing to appear for an enquiry, this Court finds no fault with that action. Hence, this Court is not inclined to interfere with the matter.
