Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus to direct the respondents 1 and 2 to produce the body or person of the detenu namely, S.Lavanya, D/o.S.Sivakumar, aged about 15 years, before this Court and hand over the custody to the petitioner.

ORDER

[Order of the Court was made by N.ANAND VENKATESH, J.] The grand-mother of the detenu has filed this Habeas Corpus Petition to secure her grand-daughter namely, Lavanya, aged about 15 years, who is said to be missing from 21.10.2022 onwards.

2. Mr.P.Baskaran, Special Sub Inspector of Police, Sapdur Police Station, Peraiyur Sub Division, Madurai District, was present at the time of hearing and he produced the detenu before this Court.

3. We enquired the detenu and she stated that she was studying in +1 and she was staying in her grand-mother's house at Madurai. Since

steps were taken to get her married, she went away from the residence of the petitioner and she expressed her willingness to continue her studies.

4. The father of the detenu was also present before this Court and he stated that he along with his wife were living in Chengalpattu. However, considering the welfare of the detenu, they have decided to come back to Madurai and they are going to stay along with the petitioner and take care of the detenu. The detenu also expressed her willingness to go along with her father.

5. In view of the above development, no further orders are required to be passed in this Habeas Corpus Petition and the same is closed. (M.S.R.,J.) (N.A.V.,J.) 17.11.2022 Index : Yes/No Internet : Yes rm
