PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus directing the respondents to take appropriate action to prevent illegal extraction of Ground Water in Athipalayam Village, Vettamangalam East and West Village and Kombupalayam Village, Pugalur Taluk, Karur District and further directing the respondents to take appropriate measures to preserve and protect the ground water by appointing monitoring committee for the purpose of periodical and surprise inspection regarding the illegal extraction of Ground Water for commercial purpose and also further directing the respondents to register criminal cases against the persons illegally sucking ground water in the aforesaid areas. ORDER
(Order of the Court was made by S.M.SUBRAMANIAM, J.) When the matter is taken up for hearing today, the learned Government Pleader appearing for the respondents 1 to 3 submitted that the 2/5
extraction of groundwater for commercial purposes has now been regulated by the Government.
2.In view of the above, in the absence of a proper licence, the petitioner is at liberty to give a complaint. On receipt of such a complaint, the concerned authorities are bound to initiate appropriate action, including criminal prosecution, against the persons involved in illegal extraction of ground water for commercial purposes.
3.With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
