Heard the learned counsel appearing for the writ petitioner and the learned Additional Government Pleader appearing for respondents 1 and 2.

2. The petitioner and two others have filed O.S.No.1 of 2023 before the District Judge, Karur. Apprehending that there may be creation of encumbrance or alienation of the 2/4

3 W.P.(MD)NO.24213 OF 2023 petition-mentioned property, the present writ petition came to be filed.

3. Since the petitioner has already filed a civil suit, he has to necessarily work out his rights only in the pending suit. It is for the petitioner to file IA. The registering authority can be one of the respondents in the IA. alone. It is not necessary that he should be made as party in the main suit.

4. Granting such liberty to work out the petitioner's rights in the pending suit, this writ petition stands disposed of. No costs.
