PRAYER in W.P.(MD)No.24706 of 2019: Writ Petition filed under Article 226 of the Constitution of India, praying for a Writ of Mandamus, directing the respondents to settle the claim made by the petitioner towards reimbursement of medical expenses incurred to the tune of Rs.1,31,910/- with applicable interest, within the time stipulated by this Hon'ble Court.
PRAYER in W.P.(MD)No.24708 of 2019: Writ Petition filed under Article 226 of the Constitution of India, praying for a Writ of Mandamus, directing the respondents to settle the claim made by the petitioner towards reimbursement of medical expenses incurred on 26.04.2013 to the tune of Rs.34,572.50, with applicable interest within the time stipulated by this Court.
For Petitioner : Mr.G.Karthik M/s.T.Lajapathi Roy For Respondents : Mrs.D.Farjana Ghoushia Special Government Pleader [In both Writ Petitions] COMMON ORDER The prayer sought for in these Writ Petitions has now been achieved in view of the fact that subsequent to the filing of these Writ Petitions, the amount spent by the petitioner towards his 2/5
medical expenses has been reimbursed. However, learned Counsel for the petitioner would submit that for the delayed payments made by the respondents, the petitioner is entitled to claim interest for which liberty may be granted to the petitioner to submit a representation to the respondents. No prejudice will be caused if such a liberty is granted.
2.After recording the fact that the petitioner has been reimbursed with the medical expenses incurred and the prayer sought for in this writ petition has been achieved, these writ petitions are closed. However, liberty is granted to the petitioner to submit a representation to the respondents seeking for payment of interest if he so desires and the respondents shall consider the same on merits and in accordance with law. There shall be no order as to costs.
