ORDER

This Criminal Original Petition has been filed seeking to quash the charge sheet in C.C.No.124 of 2020 on the file of learned Judicial Magistrate, Keeranur.

2. When the matter is taken up for hearing, the learned Additional Public Prosecutor appearing for the respondent police submitted that so far two witnesses have been examined and without cross examining all the witnesses, this petition has been filed seeking quashment.

3. When the trial is commenced, it is the duty of the petitioner to cross examine all the witnesses. From the note made by the respondent, it is seen that P.W.1 was chief examined on 01.10.2021 and P.W.2 was examined in Chief on the very same day. Now the case is posted for cross examination of all the witnesses.

4. Pending trial, the quashment of C.C.No.124 of 2020 does not arise. The petitioner is directed to face the trial process before the trial Court by cross examining all the witnesses. Considering the oldness of the case, the learned Judicial Magistrate, Keeranur is directed to complete the trial process within a period of five months from the date of receipt of copy of this order. Since the petitioner is affected in Cancer, her personal appearance is dispensed with on the following condition without going into other aspects; (i)The petitioner shall appear before the learned Judicial Magistrate, Keeranur, within a period of 15 days from the date of 2/4

receipt of a copy of this order and file an undertaking affidavit, by affixing her recent passport size photograph, to the effect that he will appear before the trial Court as and when required and must ensure her proper representation through Advocate.
