JUDGMENT

This Second Appeal is filed to set aside the judgment and decree, dated 18.02.2016 made in A.S.No.43 of 2015 on the file of VI Additional District Judge, Madurai, confirming the judgment and decree, dated 07.04.2015 made in O.S.No.358 of 2011 on the file of the V Additional Subordinate Judge, Madurai.

2. When the case was taken up for hearing on 29.10.2025, there was no representation for the appellant and therefore, the case was directed to be listed on 03.11.2025 under the caption 'for dismissal'. On 03.11.2025, when the case was taken, the learned counsel for the appellant appeared and sought short accommodation for taking steps for deceased sole appellant and hence, the case was posted today as finally. Even today (11.11.2025), there is no representation for the appellant and steps for deceased sole appellant have not been taken.

3. Therefore, this Second Appeal is dismissed for default. No costs. Consequently, the connected Civil Miscellaneous Petition is closed.
