ORDER

Heard Mr.A.D.Ganeshamoorthi, learned counsel appearing for the Petitioner and Mr.P.Thambidurai, learned Government Advocate appearing for the Respondents.

This Writ Petition has been filed under the Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the Respondents to sanction annual notional increment for the year 1998 and to be revise petitioner's pension based on the petitioner's representation dated 12.04.2023.

Mr.A.D.Ganeshamoorthi, learned counsel for the Petitioner submits that since the respondents have not paid any heed to the petitioner, several representations were made before the respondents. The last representation was made on 12.04.2023 outlining his claim and grievances before the Respondents, which finds place at page no.25 2/6

of the paper book. Despite the said representation, the Respondents failed to take action, prompting the Petitioner to file the present Writ Petition seeking the aforementioned prayer.

Mr.P.Thambidurai, learned Government Advocate for the Respondents, submits that the Respondents are willing to consider the relief sought by the Petitioner if she makes a fresh representation before them, outlining his grievances. The Respondents would then consider and decide on the matter in accordance with the law within the time frame fixed by this Court.

The learned counsel for the Petitioner, agreed to the submissions made by the learned Government Advocate for the Respondents and submits that the Petitioner is willing to file a fresh representation before the first respondent, which may be directed to be disposed of within a specified time frame.

After considering the submissions made by the learned counsels for both parties and perusing the records and averments made in the Writ 3/6

Petition, this Court deems it appropriate that no useful purpose will be served in keeping this Writ Petition pending before this Court. 7.

Accordingly, without expressing any opinion on merits, the Petitioner is directed to file a fresh representation before the first Respondent/the Principal Secretary/Commissioner of Revenue Administration, Ezhishagam, Chepauk, Chennai-5, detailing his claim and grievances, annexing therewith a certified copy of this order and a copy of his earlier representation dated 12.04.2023, within a period of two weeks from today. If any such representation is filed by the Petitioner before the first Respondent, as per the time stipulated by this Court, the first respondent is directed to consider the same and pass a reasoned and speaking order on merits and in accordance with law, after giving sufficient opportunity to the Petitioner, within a period of four weeks from the date of receipt of such representation. The first Respondent shall communicate the order/decision to the Petitioner through Registered Post with Acknowledgement Due (RPAD) within a period of two weeks from the date of passing the order/decision.

With the above directions, this Writ Petition is finally disposed of. There shall be no order as to costs.
