ORDER

This Criminal Original Petition has been filed, invoking Section 528 of BNSS, seeking orders, to direct the Judicial Magistrate Court, 1/4

Karaikudi to dispose of the C.C.No.235 of 2017 renumbered as C.C.No.714 of 2022 within the time frame stipulated by this Court.

2. It is evident from the records that the respondent police has registered a case in Crime N.101 of 2017 against the petitioner for the alleged offence under Sections 279, 337, 304(A) of IPC and after completing the investigation, charge sheet came to be filed and the case was taken on file in C.C.No.235 of 2017 on the file of the District Munsif cum Judicial Magistrate Court, Karur and after bifurcation of the Courts, the case was renumbered as C.C.No.714 of 2022 and is pending on the file of the learned Judicial Magistrate, Karaikudi.

3. The learned Government Advocate (Criminal Side) appearing for the State would submit that the trial is not yet commenced and posted to 23.12.2024 for examination of P.W.1 to P.W.3. 4.Though the case is pending from 2017, the trial Court has posted the case for examination of P.W.1 to P.W.3.

Considering the above facts and circumstances of the case and taking note of the fact that the case is pending from 2017 onwards, the trial Court is directed to proceed with the trial and dispose of the case in C.C.No.714 of 2022 within a period of four months from the date of receipt of copy of this order.

6. With the above observation and direction, this Criminal Original Petition stands disposed of.
