Mr.R.Suresh Kumar Government Advocate (Crl.side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.181 of 2023 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 394 and 398 IPC in Crime No.181 of 2023 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the accused persons have trespassed in a TASMAC shop, in which the de-facto complainant is working as a Salesman, and 1/3
demanding money from the de-facto complainant. When it was refused by the defacto complainant, the accused persons have abused him in filthy language and attacked him with dire consequences. Hence, the case. 3.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.side)appearing for the respondent police. 4.The learned Government Advocate (Crl.side) would submit that the petitioner and other accused have trespassed into a TASMAC shop and threatened the de-facto complainant with dire consequences. He also opposed grant anticipatory bail on the ground that the investigation is not yet completed. 5.Considering the submission made by the learned Government Advocate (Crl.side) and also considering the nature of offence alleged to have been committed by the petitioner, this Court is not inclined to grant anticipatory to the petitioner. Hence, this petition is dismissed.
