ORDER

This Civil Miscellaneous Petition has been filed to condone the delay of 282 days in filing the Civil Miscellaneous Appeal in C.M.A. (MD)SR No.74774 of 2024 before this Court.

2. Heard the learned counsel appearing on either side and perused the affidavit filed in support of this petition.

3. The name of the 1st respondent has been printed in the cause list.

4. The learned counsel for the 2nd respondent submitted that, if the present petition is allowed, the interest for the default period of 282 days may be waived.

5. Being satisfied with the reasons stated in the affidavit, and also considering the submission made by the learned counsel for the 2nd 2/4

respondent, this Civil Miscellaneous Petition is allowed. The petitioner is not entitled to interest for the default period of 282 days.

6. The Registry is directed to number the Civil Miscellaneous Appeal in C.M.A.(MD)SR No.74774 of 2024, if it is otherwise in order, and list the same in the usual course.
