ORDER : The Court made the following order :- The petitioner/Accused No.1, apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 427 and 506(i) of IPC, in Crime No.103 of 2022 on the file of the respondent police, seeks anticipatory bail. 2.The learned Government Advocate (Crl. Side) submitted that the petitioner was granted anticipatory bail by the learned Principal District Judge, in Crl.M.P.No.5458 of 2022 on 10.10.2022 with conditions. That petition has been suppressed in this petition and they have not complied the above said order also. 3.The learned counsel for the petitioner submitted that since the above said order has not been complied, that anticipatory bail order was automatically cancelled because of the non compliance of the order. If it so, the petitioner ought to have approached the same court seeking extension of time or by filing any other https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.20289 of 2022 appropriate petition. In stead of doing so, the petitioner suppressing the earlier petition, approached this Court stating that it is the first application before this Court. It is clearly abuse of the process of the Court. On this sole ground, this petition deserves to be dismissed.
