the Court of First Instance and the material papers in the Suit and upon hearing the arguments of Mr.V.NAGARAJAN, Advocate for the Appellant and of Mr.V.RAMAKRISHNAN, Advocate for the respondent, this Court while allowing the Second Appeal doth order and decree as follows:-

(1) That the Judgment and Decree of the VI, Additional District Court, Madurai dated 28.01.2016 made in Appeal Suit No.40 of 2015, be and hereby is set aside and suit is dismissed.

(2) That there be no costs in this Appeal.
