Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondents not to disconnect the electricity connection in electricity number 05-166-010-1646 on the basis the petitioners representation dated 16.11.2019.

ORDER

This writ petition has been filed seeking a direction to the respondents not to disconnect the electricity connection in electricity number 05-166-010-1646 on the basis the petitioners representation dated 16.11.2019.

The facts as set out in the affidavit filed in support of the writ petition reads as follows:- The petitioner would submit that his father late Mohan had purchased the property in Re Survey No.65/11, measuring an extent of 09 cents situated at Kallanai Village, Vadipatti Taluk, Madurai District vide registered Document No.1041 of 2002. While so, on 30.10.2013, his father had passed away leaving behind the petitioner, his sister and his mother as the surviving legal heirs.

3. He would submit that subsequent to his father's death, he has been taking care of his mother namely Sowthamani. His mother is also receiving a sum of Rs.20,000/- as pension amount from his father's death and the same is being used for the welfare of the petitioner's sister namely Vinotha.

4. He would further submit that he is taking care of his mother from his salary and the rental income received from the shop in Re Survey No. 65/11, situated at Kallanai Village, Vadipatti Taluk, Madurai District.

At this juncture, at the instigation of his sister, his mother had submitted a representation before the respondents seeking to disconnect the electricity service connection to the above mentioned shop. Though the partition has not been effected and the names of his mother and sister also stands in the revenue records, without any valid reason his mother had submitted a representation to disconnect the electricity service connection to the shop.

He would further submit that if the electricity service connection is disconnected to the above mentioned shop then he has to repay the advance amount to the tenant and further his source of income would be affected. Therefore, he has sent a detailed representation dated 16.11.2019 to the respondents to not to disconnect the electricity service connection to the above mentioned shop. However, the no action has been taken to date. Aggrieved by the same, the petitioner has come before this Court.

7. Mr.S.Deenadhayalan, learned Standing Counsel appearing for the respondents 1 to 3 would submit that the representation submitted by the petitioner dated 16.11.2019 will be considered and orders will be passed within the time stipulated by this Court.

8. In view of the same, without going into the merits of the matter, the respondents 1 to 3 are directed to consider the representation of the petitioner dated 16.11.2019 and pass appropriate orders on merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order.

9. The writ petition stands disposed of with the above observations. No costs.
