Respondents PRAYER: This petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 2nd respondent to issue Hindu Kattunayakkan Scheduled Tribe Community Certificate to the petitioner and his school going children namely M.R.Sabarish and M.R.Veerash, by considering the petitioner's representation, dated 12.09.2018, within a time frame as may be fixed by this Court. (Order of this Court was made by T.S.SIVAGNANAM, J) Heard Mr.R.Murugappan, the learned counsel appearing for the petitioner.

2. The petitioner seeks for a direction upon the 2nd respondent to issue Community Certificate to the petitioner and his two children.

3. The learned Government Advocate, who has accepted notice for the respondents submitted that based on the direction issued to the Tahsildar, an enquiry has been conducted and enquiry report has been submitted to the 2nd respondent and the 2nd respondent has to pass orders, after affording an opportunity of personal hearing.

4. The learned counsel appearing for the petitioner submitted that one of the child is to take NEET as well JEE entrance examination, which will be conducted in December 2019 and therefore, requests that action be expedited by the 2nd respondent and orders be passed.

5. In the light of the above, we direct the 2nd respondent to fix the personal hearing during the course of next week that is the week commencing from 2nd December and after affording an opportunity of personal hearing, appropriate orders be passed on merits and in accordance with law, on or before 16.12.2019.

6. With the above direction, the Writ Petition stands disposed of. No costs.
