PRAYER :- For Bail in Crime No.206/2022 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner/A4, who was arrested and remanded to judicial custody on 19.10.2022 for the offence under Sections 294(b), 307 and 302 of IPC @ 294(b), 307, 302 and 120(B) of IPC in Crime No.206 of 2022, seeks bail.
2.The case of the prosecution is that there was a dispute between the deceased, Santhiyagu and A3 with regard to purchase sand for construction, over which, A1 to A3 waylaid the deceased and his friend and assaulted them by using lethal weapon and on account of that, the said Santhiyagu was died and his friend sustained injuries. Hence, the complaint.
3.The learned counsel for the petitioner would submit that the petitioner is an innocent and he is no way connected with the https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.20277 of 2022 alleged offence and his name has been falsely implicated in this case. He would further submit that the petitioner is in judicial custody from 19.10.2022 and hence, he prays for bail. 4.The learned Additional Public Prosecutor would submit that totally six accused involved in this case and the petitioner is arrayed as A4. Due to some dispute between the deceased and A3, the deceased was murdered by the petitioner along with other accused. The deceased's friend, namely, Palani was sustained injury and is still in hospital.
5.Considering the gravity and nature of the offence and also considering the fact that one of the victim is still in hospital, this Court is not inclined to grant bail to the petitioner at this stage.
