P RAYER : Second Appeal filed under Section 100 of the Civil Procedure Code against the Judgment and Decree, dated 15.04.2016, made in A.S.No.34 of 2015 on the file of the VI Additional District Court, Madurai, reversing the Judgment and Decree, dated 17.09.2014, made in O.S.No.214 of 2007 on the file of the Subordinate Judge (Camp Court), Thirumangalam.

JUDGMENT

The parties have appeared before the Taluk Legal Service Committee Lok Adalat and entered into a settlement. 1/4

2.The respondent herein K.Jeyachandran has accepted and agreed to receive Rs.5,20,000/- (Rupees Five Lakh Twenty Thousand only) as full and final settlement from the total outstanding amount of Rs. 5,32,457/-. The sum of Rs.5,20,000/- (Rupees Five Lakh Twenty Thousand only) was paid by the appellant and received by the respondent herein on 14.10.2023.

3. Therefore, recording the said settlement, the second appeal is ordered accordingly. The Judgment and Decree rendered by the Trial Court as well as Appellate Court is modified to this extent in the light of the settlement as stated supra. The settlement shall form part and parcel of the second appeal judgment. The appellant in the second appeal is entitled to refund of court fee.

4. Hence, the second appeal is disposed of in above terms. No costs. Consequently, connected miscellaneous petition is closed. 21.11.2023 Index : Yes / No NCC : Yes / No Tmg 2/4
