ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the 1/3

offences punishable under Section 379 of IPC r/w Section 21(1) of TNMMDR Act, 1957, in Crime No.400 of 2023 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that while on surveillance duty, the respondent police found that the accused persons have illegally transporting one unit of sand without valid permission. Hence, the case.

3.Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.side)appearing for the respondent police. 4.The learned counsel for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case. 4.The learned Government Advocate(Crl.Side) opposed the bail petition on the ground that the investigation is not yet completed. 5.It is seen that the accused have illegally transported one unit of sand without any valid permission. This offence committed by the petitioner is not only an offence against any particular individual, but against the Society at large. It affects not only the present population, but the posterity as well. In this view of the same, this Court is not inclined to grant anticipatory bail to the petitioner. 2/3

6.Hence the petition stands dismissed.
