praying this Court to issue a Writ of Certiorari calling for the records pertaining to the impugned order of transfer in A.Aa.No.10360/Nia5/ ThaAPoKa./Thili/2022, dated 23.09.2023 passed by the first respondent and quash the same.

O R D E R

The present Writ Petition has been filed by a Driver of the respondent Transport Corporation challenging the order of transfer from Valliyoor Branch to Thoothukudi Moffusil Branch.

2. Even as per the writ affidavit, the writ petitioner has been relieved from duty on 26.09.2023 and the writ petition has been presented only on 29.09.2023.

3. A perusal of the order impugned in the writ petition indicates that the transfer was on administrative grounds and the respondents have filed a counter contending that the petitioner is transferred only based on administrative reason and there are no allegations as against the writ 2/5

petitioner.

4. However, the learned counsel appearing for the writ petitioner submits that though his juniors have been retained at Valliyoor Branch, he has been transferred. It is for the writ petitioner to ventilate his grievances before the employer. This Court does not find any legally acceptable reason to interfere in the impugned order of transfer and there are no merits in this writ petition.

5. Accordingly, this writ petition is dismissed. However, this will not preclude the employer from considering the request made by the writ petitioner for re-transfer or transfer to some other Depot. There shall be no order as to costs. Consequently the connected Miscellaneous Petition is closed.
