Order : This criminal miscellaneous petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/s.R.PARANJOTHI, Advocate for M/S. KBS LAW OFFICE, Advocate for the petitioner and of MR.S.RAVI, Additional Public Prosecutor on behalf of the Respondent, the Court made the following order:- This petition has been filed seeking to modify the condition no. 9(iii) imposed by this Court in the order dated 31.07.2024 in Crl.M.P(MD) No. 707 of 2024 in Crl.A (MD) No.263 of 2023.
2. While granting suspension of sentence the Division Bench of this Court had imposed a condition that the petitioner shall stay at Tirupur and report before the Inspector of Police, Tirupur Town Police Station, daily at 10.30 a.m., until further orders.
3. It is contended by the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor that the petitioner had been complying with the condition on and from 14.08.2024.
4. In the affidavit filed in support of the petition it had been stated that the parents of the petitioner are aged and that his presence would give some comfort to them. It is also stated that one of his brother is also physically challenged. It is also stated that staying at Tirupur has caused much financial crisis and hence he has filed the present petition to relax the condition.

5. We have carefully considered the rival submissions.
6. Taking into consideration all the factors we would modify the condition no. 9 (iii) and direct the petitioner to stay at Trichy and report before the Inspector of Police, Fort Police Station, every Saturday at 10.30am., until further orders.
