COMMON PRAYER: Writ Appeals are filed under Clause 15 of the Letters Patent Act, to set aside the order of this Court made in W.P.(MD)Nos.2280 and 27899 of 2023 dated 06.08.2024.

These intra-Court Appeals are filed against the orders of this Court in W.P.(MD)Nos.2280 and 27899 of 2023 dated 06.08.2024. 2/6
2.The writ petitioner is running a club in the subject property. However, the writ petitioner has not paid the lease amount. Hence, the club was locked and sealed. The writ petition challenging the lock and seal was allowed by the learned Single Judge. The other writ petition challenging the interim measure to run an indoor stadium in the subject premises was also allowed. Challenging the said orders, the Department has filed these appeals. 3.The main contention of the appellants is that there are huge arrears of lease to the tune of around Rs.20 lakhs.
4.Whereas, the learned counsel for the writ petitioner submits that only a sum of Rs.18 lakhs alone has to be paid towards arrears of lease. 5.Considering the above said submission, we direct the writ petitioner/respondent to pay the admitted arrears of Rs.18 lakhs in two instalments. The first instalment of Rs.10,00,000/- (Rupees Ten Lakhs only) shall be paid within a period of one week from the date of receipt of a copy of this order. The second instalment of Rs.8,00,000/- (Rupees Eight Lakhs only) shall be paid within a period of one month thereafter. On payment of first instalment within the time prescribed by this Court, the appellants are directed to 3/6
consider the representation of the petitioner for opening the club in the subject premises in accordance with law within period of twelve weeks therefrom. 6.With the above direction, these writ appeals are disposed of. By earlier order dated 07.04.2025, the respondent in both the appeals were directed to pay the first instalment amount of Rs.10,00,000/- within a period of one week. It is stated that the same is paid within the stipulated time. 4/6
