Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents to settle the arrears of Dearness Allowance for the periods from January 2018 to March 2018 (3 months), July 2018 and August 2018 (2 months), January 2019 to April 2019 (4 months) and July 2019 to September (3 months) for total period of 12 months which were not settled till the date of retirement on 30.04.2020 along with belated payment interest at the rate of 6% p.a. from the date of retirement till the date of payment.

ORDER

The present writ petition has been filed by a retired Driver of the respondent Corporation seeking a Mandamus to direct the respondent Corporation to settle his terminal benefits.

2. According to the learned counsel appearing for the petitioner, the petitioner had attained superannuation on 30.04.2020 and so far, the respondents have not settled the arrears of dearness allowance for the period between January 2018 to March 2018, July 2018 and August 2018, January 2019 to April 2019 and July 2019 to September 2019. He has prayed for granting of interest at the rate of 6% per annum for the belated settlement.

3. Considering the above said facts, this Court directs the 2nd respondent to settle the arrears with 6% interest within a period of twelve

(12) weeks from the date of receipt of a copy of this order. 2/4

4. With the above said observations, this Writ Petition stands allowed to the extent as stated above. No costs. 13.10.2023 NCC :
