(Order of the Court was made by M.SUNDAR,J.,) Mr.C.Masilamani, learned counsel for petitioner, Mr.R.Meenakshi Sundaram, learned Additional Public Prosecutor for official respondents (respondents 1 to 4) and Mr.Eswar Kumar and Rao, No.192/, Karaneeswara Pagoda Street, Mylapore, Chennai, who says he has entered appearance for the fifth respondent (private respondent) are before us.
2.This proceeding has to be read in conjunction with and in continuation of earlier proceedings made in the previous listing on 16.10.2023.
3.The status report dated 16.10.2023 filed by the fourth respondent inter alia shows that the entire occurrence was in Krishna Pattinam, Andhra Pradesh and the Case Diary (CD) has also been transferred. This Court is informed by the fourth respondent that First Information Report has also been registered in the jurisdictional Police Station in the State of Andhra Pradesh.
4.Today, learned counsel for HCP petitioner has been favoured with the copy of the aforesaid status report. 5.Learned counsel for HCP petitioner requested some time to get instructions and revert to this Court. Request acceded to.
6.List three weeks hence. List on 20.11.2023.'
2.Today, Mr.C.Masilamani, learned Counsel on record for HCP petitioner sought leave of this Court to withdraw the captioned HCP but made a plea to preserve all the rights of HCP petitioner and or anyone concerned for the absentee to move the jurisdictional Court. Request acceded to.
3.We make it clear that we have not expressed any view or opinion on the merits of the matter and if the jurisdictional Court is moved by the HCP petitioner or anyone concerned for the absentee, this order will neither impede nor serve as an impetus for the same. 4.Captioned HCP is disposed of as closed albiet preserving all the rights in the aforesaid manner.
